Terms & conditions

Please read carefully through the below T&C’s for your headshot session.

By booking this session & paying the fee you (The Client) are agreeing to the following:

No images or services shall be provided before the payment (the booking fee) is made in full.

 

The fee for the Headshots Session is not refundable. If the client needs to cancel, the fee will not be refunded.


The Client shall receive 3 high quality images as part of their fee. The client will be offered the chance to purchase more photos for an additional fee.


As an artist, I reserve the right to artistically interpret what I see and in what ways I choose to photograph a scene. Images presented to the client are the only images available.

I agree that Sarah Tulej Photography may use the images with or without my name for any lawful purposes, including but not limited to publicity, illustration, advertising, and web content.


If the Client is more than 10 minutes late and has made no contact to the photographer (email, text or phone call), the session will be considered cancelled and the fee will be lost.

 

Photoshoots can not be postponed or the date transferred.

If the photographer decides to cancel for any reason all fees paid will be refunded to the client.

​

Any and all orders for additional images must be made within 60 days of the photoshoot. Once the order has been received, unless otherwise specified (and agreed upon with the photographer) all the originals will be discarded and no other orders will be available to order. If prices per images or prints shall change, client must pay the current prices of the date that the order is made.


If the 60 days have passed, at the photographer's discretion the gallery can be re-opened for a maximum of 1 week.

Payment

​

The Client shall pay a fee to the Photographer to perform the services specified herein. The client shall pay the fee upon booking the session. This amount is payable via bank transfer. The booking is only confirmed once the photographer has received the payment.

Liability

The photographer takes the utmost care with regard to storing, transporting and processing the photographs. However, in the unlikely event that the photographs are lost, stolen, or destroyed for reasons within or beyond the photographers’ control, liability is limited to the return of all monies received for the package.

 

The photographer can not be held liable for consequences beyond their control at the shoot location. This includes but is not limited to bad weather, poor lighting, disruption caused by other people not connected to the shoot, the location or management refusing the right to carry out the shoot, the location being unexpectedly inaccessible for any reason.

Weather

If the weather is too poor to go ahead with the shoot, the photographer will contact the client to reschedule the shoot. If this occurs, the shoot must be rescheduled to a date within 4 weeks of the original shoot date, weather permitting.

 

Client appearance

During the shoot the photographer will guide and support the client to achieve the best possible results.

 

The photographer is not responsible, however, for any body or confidence issues the client may have about themselves. While the photographer will work in a way to build confidence and use the most flattering poses, lighting and compositions, they can not be held responsible for any issues around the images regarding the client’s specific dislike of e.g. wrinkles, body shape, teeth, hair, etc.

 

While the photographer will advise and support wherever possible, it is the client's responsibility to ensure that their clothing, hair, or any other elements of their appearance is looking to their satisfaction during the shoot.

 

The photographer’s brand and messaging is built around confidence and authenticity and the belief that everybody is worthy of being photographed. The client understands that the photographer does not use Photoshop to change the image of the client. Basic editing such as the removal of spots and blemishes will be carried out but no changes will be made to the permanent features of the client.

 

Any sensitive information or personal data shared during the shoot or planning process by the client with the photographer will be kept strictly confidential.

 

Image delivery

The final delivery of the gallery will be within a maximum of 4 weeks of the shoot, however the photographer will strive to deliver the images sooner.

 

The photographer will share a proofing gallery of the unedited images, from which the client can select their final images.

 

The photographer will then edit the final images and send a link to the client to online gallery from which to download the images.

 

The photographer strongly recommends that the client downloads all the images as soon as they receive them, and makes their own backups online and offline.

 

Licence of “Model Rights” to photographer

Model Right means Model Right means any right of a person to the privacy of their personal image or other feature by which they could be identified.

 

The client grants all their Model Rights to the photographer to enable them to carry out the assignment. The client agrees that the photographer may use their personal Model Rights (but not those of any other person present) in the form of images taken in this assignment, only:

 

  • to market their business as a photographer;

  • for sale of a licence to a third party for commercial use of the images (only if the photographer receives explicit written permission from the client);

  • for sale of a licence to any bona fide publisher of related material (only if the photographer receives explicit written permission from the client).

 

Image usage & copyright

The copyright of the images will remain with the photographer. This means that the photographer has the right to use and publish photographs of the client for the promotion of their business and services, including editorial, trade, advertising and any other purpose.

 

The client has permission for the full commercial use of their images, including, but not limited to social media, website, and use of the images in the press and media. The client cannot sell any images provided by the photographer for commercial gain or give them away to other parties to use commercially.

 

Wherever possible and appropriate, the photographer requests the client to credit the photographer for images that are published.

 

The client has permission to crop and overlay graphics and text on the images, but the editing of the images (e.g. changing colour, exposure, adding a filter) is not permitted without prior discussion with and consent from the photographer.
